Mediation
Mediation is a process by which an impartial and neutral third party, the mediator, assists parties and their representatives in resolving their disputes. Mediation is a voluntary, private, and confidential process whereby the mediator assists the parties but does not dictate an outcome. Mediation can happen before a dispute proceeds to litigation or trial and can save the accompanying costs and risks associated with a trial. A mediator can help identify common ground, gain concessions, listen carefully, and suggest proposals, aiding the parties in reaching a mutually beneficial resolution.

Arbitration
Arbitration is a private process that resolves disputes outside the court system. Arbitration is a creature of contract; the parties’ arbitration agreement controls the conduct of the arbitration and the authority of the arbitrator. The process is more efficient and flexible than traditional litigation with a jury trial and appeal, while providing a fair, neutral and just resolution. Organizations such as the American Arbitration Association can administer the process for the parties and their counsel, or parties can select an arbitrator directly in an “non-administered,” or “ad hoc” arbitration.
